Horizontal fold in the middle of the sheet; small tear at the top edge without loss of text. On the reverse, light soiling in the lower part, two faint round seal impressions at the top, registration number “3059” and a flourish marked in ink. Condition: good.

Handwritten judicial document from the early Austrian period in Galicia with a heraldic seal. Of collecting interest as a sample of the noble court’s record-keeping.

INFORMATION

The document was drawn up on September 28, 1802, in Tarnów by the body that heard civil cases involving the Galician nobility under Austrian rule. The Tarnów court informs the person acting as the assignee of Adalbert Tettmaier, that is, the purchaser of his claim, that the Lviv Noble Court judgment for 1,000 florins against Theodosia Wąsowiczowa has not been entered into the tabular books: the debtor has no tabular property. A copy of the judgment not entered into the tabular books is issued to the assignee.

Intabulatio — the entry of a right or debt into the tabular, that is, land, books; it secured the claim against the debtor’s immovable property. Without tabular property, the entry had no subject matter, so the judgment remained unsecured. The noble courts (Forum Nobilium) were introduced in Galicia by the judicial reform of Joseph II as courts of first instance for the nobility, higher clergy, and owners of tabular property; the Lviv court operated from 1784, and later new fora appeared, including the Tarnów court, which operated until 1855.

The mark “Copia simplex” means a simple, uncertified copy. The stamped paper with the “3 Kreutzer” impression indicates payment of the state stamp duty, which was collected on official documents in the Habsburg monarchy.
